Liability & Disclosure

Below, is a large text version of the Release of Liability you are agreeing to by renting any Equipment from Hutch and Sons' Outdoor.

All persons using or handling equipment provided by Hutch and Sons' Outdoor MUST sign a physical copy and submit it either directly to Hutch and Sons' Outdoor, or digitally by email of a scanned image of the physical document. This ensures protection for all parties involved.

Release of Liability / Waiver Agreement with Alexander J Hutchison.

(A) Alexander J. Hutchison will be referred to as “The Lessor” within this document. The Renter understands that “The Lessor” refers to this person, from whom The Renter(s) are renting from.

(B) “The Renter” is referring to the person and guardian who sign this document, and thus has permission from The Lessor to use the equipment in accordance with the agreements in this document.

(C) By renting equipment from The Lessor and/or by signing the waiver below, The Renter acknowledges their understanding of, and agrees to the following; statements, terms, and conditions.

The Lessor, and The Renters, agree to act in good faith, per the terms of this agreement, by signing, The Renter acknowledges this. The Renter acknowledges that it is The Renter’s responsibility to behave responsibly and appropriately with ANY and ALL rented equipment, owned by The Lessor. The Renter is to be found liable of any and all injury or property damage, caused from use of equipment, or while in possession of equipment, owned by The Lessor.

The Renter is aware of, and acknowledges that The Renter understands the following: There are known risks associated with, and inherent to, the sport of paintball, as well as inherent risk while handling paintball equipment. Known risks include death. Although the sport and paintball equipment can be safe when handled or used correctly, injury or death may still occur. By renting equipment from The Lessor, The Renter is recognizing that The Renter understands and accepts any and all risks associated with both handling equipment owned by The Lessor, to play, and all risks involved with playing paintball.

By renting equipment from The Lessor, The Renter acknowledges that The Renter knows and understand how to properly and safely handle paintball equipment, including, but not limited to: safe handling of paintball markers/guns; safe handling of, and connecting markers/guns to, compressed liquid/gas tanks (CO2 and/or HPA); how to properly and safely wear and secure protective equipment such as Masks/Goggles; how to properly and safely "cover" or "plug" the barrel ends of any and all markers/guns, at all times when not actively playing the game of paintball. The Renter understands the intended purpose of any and all rented equipment.

As part of the rental agreement, The Renter agrees to be responsible for any and all damages, avoidable or unavoidable, to any and all rented equipment, owned by The Lessor. This does not include cosmetic damage; scratches to anodized or powder coating on rental equipment, which occur during normal play. The Renter agrees to return the equipment in good, clean, and functioning condition, as well as inform The Lessor of: any and all damages to, any and all non-functioning equipment, as well as any and all dirty or soiled equipment prior to, and no later than, the agreed date of return. The Renter also agrees to pay any and all fees incurred by returning any or all equipment past the agreed return date, and agree to pay any and all fees incurred as a result of returning any dirty, or damaged equipment. The Renter agrees to enter into, and be bound in arbitration, concerning any disputes or disagreements between The Lessor and the Renter. Including, but not limited to: compensation for, any and all damages to equipment owned by The Lessor, as well as enter into binding arbitration in any and all cases concerning liability, regarding any disputes concerning any and all injury or injuries to any person or persons and/or damages to property, while using or in possession of any equipment owned by The Lessor. The Renter agrees that any and all disputes will be settled through arbitration by an arbiter provided by, and provided only by, The Lessor. The Renter agrees to be bound to any and all decisions or arbitrations made by the arbiter, provided by the Lessor, regarding any and all disputes, and agrees that any and all arbitrations are final.

The Renter agrees, by signing the waiver, to only allow other Renters, (persons, who have signed and submitted a waiver, or have had a legal guardian, sign and submit a waiver to The Lessor) to handle or use any equipment owned by The Lessor. The Renter agrees to prevent any persons who have not signed and submitted a waiver to The Lessor, from handling or using equipment from The Lessor. Any damages to, or caused by any persons, regardless of age, or mental state at time of incident, who were handling or using any equipment owned by The Lessor, will be the responsibility of The Renter or collective of Renters, even if the damage was caused by someone other than one of The Renters, who had not signed and submitted this document.

No person under the age of 12 is to engage in the game of paintball using the equipment, nor may handle any and all equipment owned by The Lessor. No person shall use equipment owned by The Lessor, in any way, other than in the manner in which the equipment is intended to be used. No person shall use or handle equipment owned by The Lessor, while wearing protective equipment in an unsafe or incorrect manner (not wearing a Mask/Goggles while playing). No inebriated persons, no persons with a compromised mental state, no persons with a history of violent behavior and no cognitively impaired persons, are to use or handle any equipment rented to The Renter, and owned by The Lessor, even if The Renter themselves, is a person fitting of one of these aforementioned conditions. The Renter agrees to not permit access to, or allow any persons with, or in, the aforementioned conditions and/or states. By signing the waiver, or renting the equipment, The Renter accept responsibility for any and all damages caused to any persons or property, caused by these persons with, or in, the aforementioned conditions and/or states, should these aforementioned person or persons be found not liable for any and all damages involving equipment owned by The Lessor.

By signing the waiver The Renter acknowledge that The Renter is responsible for The Renter’s own safety and any injuries that occur, as well as the safety of all other persons and any injuries that may occur to other persons, as well as any and all property damage that may occur, while in possession of, or using any equipment owned by The Lessor.

By signing below, The Renter acknowledges that The Renter has found these terms agreeable, and agrees to all terms and statements above.
